By downloading, accessing, or using TreeBarkId (the “Service”), you agree to these Terms. If you do not agree, do not use the Service.

TreeBarkId is operated by Fluxer Labs. For support, contact info@fluxerlabs.com.

You must be at least 13 years old to use TreeBarkId. If you are under the age of majority where you live, you may use the Service only with the consent of a parent or legal guardian.

We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial use, subject to these Terms and any applicable app store rules.

You may upload photos for identification and submit feedback. You retain ownership of your content. You grant us a limited license to process your content solely to operate and improve the Service (for example, generating identifications, verification context, and aggregated quality metrics).

You represent that you have the rights needed to upload the content and that your content does not violate any law or third-party rights.

TreeBarkId Pro is offered as a subscription through Apple App Store and/or Google Play. Billing, renewal, and cancellation are handled by your app store account and subject to the store’s terms. You can manage or cancel your subscription in your device account settings.

You agree not to:

• Use the Service in a way that violates laws or regulations.
• Attempt to disrupt, abuse, or bypass rate limits or security controls.
• Upload content that is unlawful, harmful, or infringes others’ rights.
• Reverse engineer or attempt to extract our proprietary prompts, routing, or backend logic.

TreeBarkId relies on third-party services (for example, AI model providers, botanical databases, hosting, and billing providers). We are not responsible for third-party services and they may be governed by their own terms and policies.

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Identification results are probabilistic and may be inaccurate. Confidence values are guidance, not guarantees.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FLUXER LABS AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR DATA, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE.

IN NO EVENT WILL OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE EXCEED THE AMOUNT YOU PAID (IF ANY) FOR THE SERVICE IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

We may suspend or terminate access to the Service if we reasonably believe you violated these Terms or are using the Service in a way that could harm the Service, other users, or third parties.

We may update these Terms from time to time. We will post the updated version on this page and update the effective date. Continued use of the Service after an update means you accept the updated Terms.
